Terms of Use
These Terms of Use ("Terms") govern your access to and use of the Word Lurch website, web app, and progressive web app (collectively, the "Service"). The Service is owned and operated by Nerdworthy Inc. ("Nerdworthy," "we," "us," or "our").
By accessing, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not access or use the Service.
1. Ownership and Intellectual Property
Word Lurch is a registered trademark of Nerdworthy Inc. Copyright (c) 2024-2026 Nerdworthy Inc. All rights reserved.
The Service and all related content and materials, including game design (graphics, logos, gameplay mechanics, user interface, layout), puzzle data (clues and answers), text, audio, visual elements, and interactive features, are owned by Nerdworthy Inc. or its licensors and are protected by applicable intellectual property laws.
2. Limited License
Subject to your compliance with these Terms, Nerdworthy Inc. grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to use the Service for personal, lawful, non-commercial use only. We reserve the right to revoke this license at any time at our sole discretion.
3. Prohibited Use
You agree not to:
- Copy, reproduce, redistribute, republish, sell, or commercially exploit the Service.
- Modify, reverse engineer, decompile, disassemble, or create derivative works.
- Scrape, automate, crawl, or collect puzzle content or other data without permission.
- Circumvent technical protections used by the Service or interfere with the Service's operation in any way.
- Use the Service in violation of applicable laws.
4. Sharing Features
The Service may allow you to share links to Word Lurch through your device's native sharing options. You may use these sharing features solely for lawful, personal, non-commercial purposes. You may not share links in a manner that is misleading, defamatory, spam-like, or otherwise harmful to Nerdworthy Inc., other users of the Service, or any person or group.
5. Access Control and Feature Availability
We may restrict access to certain puzzles, features, or content based on release schedules, user entitlements, subscription status, or other criteria determined by Nerdworthy Inc. Access to unreleased or future puzzle content is intentionally limited and may be gated by server-side controls.
6. Service Changes
We may modify, suspend, discontinue, or update any part of the Service at any time, with or without notice.
7. Data Persistence and PWA Functionality
To support gameplay continuity, the Service may store local data in your browser or device, including puzzle progress, puzzle completion states, hint balances, and preferences. Clearing browser storage, uninstalling the PWA, or changing devices will remove this data. We do not guarantee the availability or recoverability of any lost puzzle data.
8. Third-Party Services
The Service uses third-party providers for data security, measurement, and analytics. Third-party providers may process device, browser, identifier, IP, and interaction data under their own policies for measurement, analytics and fraud prevention. Your use of the Service constitutes consent to the processing described in our Privacy Policy. The Service may also link to third-party platforms (such as BuyMeACoffee) for voluntary support purposes; those platforms operate under their own terms and policies.
9. Voluntary Contributions
The Service may provide a link to BuyMeACoffee, a third-party platform through which you may make a voluntary financial contribution in support of Word Lurch. Contributions are entirely optional and do not affect your access to the Service or any gameplay features.
Contributions are processed exclusively by BuyMeACoffee. By clicking the contribution link, you leave the Service and are subject to BuyMeACoffee's own terms of service and privacy policy. Nerdworthy Inc. does not process or store your payment information and is not responsible for any payment issues, errors, or disputes arising on the BuyMeACoffee platform.
All contributions are non-refundable unless otherwise required by applicable law. Contributions do not confer any game entitlements, features, benefits, or ownership interests in the Service or in Nerdworthy Inc.
Nerdworthy Inc. intends to direct a minimum of 10% of net contributions (after third-party transaction fees) to nonprofit organizations that support access to education. This reflects our current policy and good-faith commitment. It does not constitute a legally binding obligation to individual contributors.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NERDWORTHY INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO USE OF THE SERVICE.
12. Children
Word Lurch is a family-friendly game. The Service is not directed to children under 13, and we do not knowingly collect personal information directly from children under 13. If you believe a child provided personal information, contact us and we will review. The Service does not require user accounts and does not collect personal information directly from users.
13. Governing Law and Venue
These Terms are governed by the laws of Ontario, Canada, without regard to conflict of laws rules. Disputes relating to these Terms or the Service shall be subject to the courts located in Ontario, Canada.
14. Updates to These Terms
We may revise these Terms from time to time. Continued use of the Service after updated Terms are posted constitutes acceptance of the revised Terms. We may notify users of material changes via in-app notice or by updating the Effective Date of the Terms.
